Supreme Court to Decide Cape Sunshine Law Case
Cape Girardeau, MO November 17, 2009
– Today the Missouri Supreme Court announced that it will decide the
case of Jay Purcell versus the Cape Girardeau County Commission.
Purcell sued the County Commission in 2008 over violations of
Missouri’s Open Meetings and Records Law, more commonly known as the
Sunshine Law. The case was heard by Judge Stephen Mitchell in Cape
Girardeau County Circuit Court, who found in favor of the County
Commission. Purcell later appealed Mitchell’s decision and the Court
of Appeals ruled that a county commission was not a public governmental
body that must obey the Sunshine Law.
On September 10, 2009 Purcell asked the Missouri Supreme Court to hear
the case, citing its statewide implications for the citizens and
taxpayers of Missouri. Today, the Supreme Court granted Purcell’s
application and the State’s highest court will receive legal briefs and
hear arguments on the matter.
